The founders of our Republic understood that a legal system that provided ordinary people with the ability to seek justice and compensation for wrongs that were done to them by other people, by corporations and the government was essential to creating a nation governed by the rule of law. So they placed the right to trial by jury in civil cases in our Constitution. Sadly, in recent years, large insurance companies and business lobbying groups have made our civil justice system the target of ridicule and derision. Furthermore, many unprofessional advertising tactics of a handful of lawyers companies and business lobbying groups have made our civil justice system the target of ridicule and derision. But mischaracterizing the civil court systems as a “lawsuit lottery” and unfairly criticizing and ridiculing real victims is wrong. It only deters good people who have been hurt because of someone else’s fault from pursuing their legal rights to money damages and compensation. Even worse it allows wrongdoers to escape their moral obligations to repair the damage that they have done, and it allows their insurance companies to escape their legal obligations to fairly pay for the real losses suffered by real victims.
